    Terms of Service

    Please read these Terms of Service ("Terms") carefully before using the Kalbot Learning platform. By accessing or using our service, you agree to be bound by these Terms.

    1. Platform Description

    Kalbot Learning operates as a lead-generation marketplace. We connect students/parents seeking tutoring services with independent tutors. We are not a tutoring agency. We do not employ tutors, we do not set their rates, and we do not oversee the tutoring sessions. Tutors are independent contractors.

    2. Terms for Students and Parents

    • Submission of Requests: By submitting a tutoring request, you consent to having your request details (and subsequently your contact information) shared with a matched tutor on our platform.
    • No Guarantee: While we strive to match every request, we do not guarantee that a tutor will be available for your specific needs, schedule, or budget.
    • Payments: You are responsible for paying the tutor directly for their services. Kalbot Learning is not involved in billing for tutoring sessions.
    • Liability: Kalbot Learning is not responsible for the quality of tutoring, the outcome of exams, or any disputes between you and the tutor.

    3. Terms for Tutors

    • Independent Contractor Status: You act as an independent contractor. You are responsible for your own taxes, scheduling, and curriculum.
    • Lead Access Rules: Leads are distributed based on matching criteria. The "First-Claim" system dictates that the first tutor to claim a lead is granted exclusive access to that student's contact information.
    • Prohibited Conduct: You may not: (a) contact students before officially claiming a lead; (b) share, sell, or distribute lead data to third parties or other tutors; (c) attempt to circumvent the platform's lead system.
    • Professionalism: You agree to maintain a high standard of professionalism, reply promptly to claimed leads (within 24 hours), and accurately represent your credentials.

    4. Payment Terms & Subscriptions (For Tutors)

    • Billing: Subscriptions are billed automatically on a monthly or annual basis.
    • Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing cycle.
    • Refund Policy: All subscription payments and lead credit purchases are non-refundable. We do not provide prorated refunds for mid-cycle cancellations.
    • Lead Credit Policy: If a claimed lead contains entirely invalid contact information (e.g., disconnected phone, bounced email), you may request a lead credit within 7 days. Credits have no cash value and cannot be refunded.

    5. Limitation of Liability

    To the maximum extent permitted by applicable law, Kalbot Learning shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the service.

    6. Governing Law and Dispute Resolution

    These Terms shall be governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein. Any dispute arising from or relating to these Terms shall be resolved exclusively in the courts located in Montreal, Quebec.

    7. Modification of Terms

    We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last Updated" date.
